2.2. The Agreement applies together with the Terms of Use, the Cancellation and Refund Policy, the Acceptable Use Policy and the Data Processing Agreement.

2.3. If the Buyer is a consumer, the Agreement is subject to Law No. 6502 and the Distance Contracts Regulation. If the Buyer acts for commercial or professional purposes, consumer law does not apply; the provisions specific to consumers (Articles 6 and 9.2) have no effect for that Buyer and the Terms of Use apply first.

4.2. The subscription does not renew automatically at the end of the period shown in the order summary, and no charge is made automatically to a saved payment instrument for that period (Cancellation and Refund Policy, Section 3.2). Price changes are published on the website before a new order is placed.

4.3. If the bank or payment institution does not complete the payment for any reason, the Seller has no obligation to provide the Service.

Article 5. Performance of the service

5.1. The Service is performed electronically by giving access through the Buyer's Account on the Platform. If the Buyer is a merchant, access is given and performance begins when payment is completed; if the Buyer is a consumer, performance starts before the withdrawal period ends only with the consumer's express consent, and without that consent performance starts when the withdrawal period ends (Article 6). There is no physical delivery and no delivery cost.

5.2. The internet connection and compatible browser needed to access the Service are the Buyer's responsibility.

5.3. The scope, terms of use, warranties and limitations of liability for the Service are set out in the Terms of Use.

Article 6. Right of withdrawal (only if the Buyer is a consumer)

6.1. If the Buyer is a consumer, the withdrawal period is 14 days and starts on the day the contract is concluded. Performance of the Service starts before the withdrawal period ends only with the consumer's express consent. If the consumer gives that consent, the consumer cannot exercise the right of withdrawal under Article 15(1)(ğ) and (h) of the Distance Contracts Regulation.

6.2. If the consumer does not give express consent, performance of the Service starts when the withdrawal period ends, and the Buyer may exercise the right of withdrawal within the withdrawal period.

6.3. If the Buyer is a consumer, the Buyer may end the subscription at any time under the Subscription Agreements Regulation, without giving reasons and without a penalty, and the Regulation applies to that.

6.4. Notice of withdrawal can be given by email to info@alvaraai.com, and also to the KEP or postal address if one is published in the company information; using the standard withdrawal form is not required; the sample withdrawal notice in the Pre-Contract Information Form may be used. If the right of withdrawal is properly exercised, the price paid is refunded no later than 14 days after the withdrawal notice reaches the Seller; this refund is the statutory exception to the rule in Article 7 that fees are not refunded and is not an allowance restoration.

Article 7. Cancellation and refunds

The terms for cancellation, plan changes and fees are set out in the Cancellation and Refund Policy. Accordingly, fees will not be refunded; cancellation takes effect at the end of the current billing period and no pro rata refund is given. The fee for purchased additional lead allowance will also not be refunded. Mandatory consumer rights under statute, in particular the right of withdrawal in Article 6, remain reserved. An "allowance restoration" is separate from a fee refund: it means only a lead allowance restoration, which is an in-account unit and will not be converted into money. Plan scope, rights and the conditions for restoration are published on the website and in your account; the Company may change them on reasonable notice.

Article 8. Statements and obligations of the parties

8.1. The Buyer confirms that it has read and electronically approved the Pre-Contract Information Form, which contains the basic features of the Service, the total price, the payment method, the performance terms and the information on the right of withdrawal.

8.2. The Buyer confirms that the information given when ordering is accurate and current.

8.3. The Buyer undertakes to use the Service in line with the Terms of Use, the Acceptable Use Policy and applicable law.

8.4. The Seller is responsible, within the framework of the Terms of Use, if the Service cannot be performed because of force majeure or interruptions in Third-Party Services.

Article 9. Dispute resolution

9.1. This Agreement is governed by the laws of the Republic of Turkey.

9.2. If the Buyer is a consumer: within the monetary limits announced each year by the Ministry of Trade, applications may be made to the Consumer Arbitration Committee at the consumer's place of residence or where the transaction took place; for disputes above these limits, to the Consumer Courts, subject to mandatory mediation provisions. Complaints may also be sent to the Seller's contact addresses.

9.3. If the Buyer is a merchant: subject to mandatory mediation provisions, the courts and enforcement offices named in the company information have jurisdiction; if none is named, those at the Seller's place of residence.

Article 10. Effect

The Agreement is concluded and takes effect on the date the Buyer approves it electronically. Where the order flow provides approval records and a copy, a copy of the approved text is sent to the Buyer's email address and kept accessible in the Buyer's Account, and the Seller then keeps the approval records for the period required by law.
